Prohibition on e commerce with CBD products

The Medical Products Agency banned a Dutch company from selling products containing CBD, a substance extracted from the cannabis plant, to customers in Sweden.

The decision was appealed, but now the administrative court has ruled that the Medical Products Agency has had the right to ban the sale even though the sale has taken place via the internet from another EU country.

The products were sold with claims about medicinal properties and should therefore, according to the Medical Products Agency, be defined as medicines, which means that the sale requires approval.

The company, for its part, claimed that Swedish rules do not apply because the sale took place via the internet from the Netherlands.

“Medicines sold in this country must be approved here, even if the sale takes place via the internet. We believe that the e-commerce law does not affect that kind of requirement “, says lawyer Anna Maria Åslund Nilsson in a press release.
