Murderers are pardoned after 19 months in prison

On October 28, 2020, the police were called to a fast food restaurant in central Boden. A 19-year-old with a gunshot wound is found at the scene. The man was taken to hospital but later died from his injuries.

According to the investigation, an argument had occurred and a 45-year-old man shot the plaintiff dead with a modified staple gun. The perpetrator was later arrested and subsequently sentenced to 16 years in prison. The convicted man previously appeared in around 25 episodes in the criminal record.

Determined by the Court of Appeal

The sentence was confirmed by the Court of Appeal in 2021 and the Supreme Court then denied the man permission to appeal.

In early July 2023, the man applied for deferred enforcement, according to documents from the Ministry of Justice that Dagens Juridik has seen. The man stated that his health “deteriorated rapidly” and that the execution of the sentence would therefore be postponed.

On December 21, 2023, the man is granted clemency by Minister of Justice Gunnar Strömmer (M). The man must be “released immediately”, according to the decision that Dagens Juridik has seen.

In a statement from the Probation Service, it is stated that: “The medical advisor of the Probation Service assesses that the convicted man’s care needs cannot be met at the institution.” and as a result, there are “medically barred to enforcement.”

Is for exceptional situations

According to the form of government, one of the constitutions, the government may pardon someone from a criminal penalty or mitigate the penalty. It is the government’s business to try each individual case and mercy is for exceptional situations.

During the current mandate, the government has granted clemency to five people. In most cases, these are comparatively mild punishments. Dagens Juridik has listed the five previous cases:

• Granted clemency to five months in prison for, among other things, theft.

• Convicted for, among other things, unlawful persecution – granted a pardon to four months in prison

• Convicted of money laundering offense – granted clemency to one year in prison.

• Convicted of illegal driving – granted a pardon to fourteen days in prison
