Court of Appeal: No dispute in the Malin case

Court of Appeal No dispute in the Malin case

There is no dispute as the Court of Appeal will hear the indictment concerning the murder of 16-year-old Malin Lindström in Husum in 1996. This is stated by the Court of Appeal for upper Norrland, which has tried the dispute after both prosecutors and defense presented a dispute against the entire Court of Appeal for lower Norrland. The Armed Forces had also included board members who live in Örnsköldsvik municipality.

“The Court of Appeal for Upper Norrland has now tried the issue of non-compliance and found that what the prosecutor and the defense have stated or what has otherwise emerged in the case does not include such a circumstance which means that all judges at the Court of Appeal or all judges from Örnsköldsvik are disqualified. The objections to the dispute have therefore been left without approval “, the Court of Appeal for Upper Norrland writes in a press release.

At the end of May, the Supreme Court granted relief in the case to the detriment of a 44-year-old man who had previously been acquitted of the murder of Lindström.

The reason for the objections to the dispute has been stated to be that there must be no doubt whatsoever that it will be a fair trial, the Court of Appeal writes.
