Lawyers for terrorist detainees in Tyresö: Munavel in Säpo hearing

The four terror suspects in Tyresö has been questioned by Säpo.
The lawyers have, after an unusual and punitive decision, received a special ban.
– It is secret, says defender Slobodan Jovicic.

The bomb blasts in Tyresö on Thursday afternoon were coordinated by the national task force, Sweden’s ultimate police resource and anti-terrorist force.

Two of the four people were arrested at the same time, the third was taken a few minutes earlier and the fourth could be captured just over three hours later.

All are now under arrest for serious weapons offenses and preparation for terrorist offences. According to Säpo, the case is linked to the terrorist organization Islamic State, IS, in Somalia and serious organized crime.

– We have acted against a grouping of individuals within the violent Islamist extremist environment, said Fredrik Hultgren-Friberg, at Säpo’s press service, after the raids.

The security police interrogated the terror suspects during Friday.

The prosecutor’s move in the Säpo hearing

The case is surrounded by high secrecy and the prosecutor, at the National Security Unit, has therefore decided on a so-called yipping ban. Which means that everyone in the interrogation room is gagged and is prohibited from commenting at all on what was said.

None of the four’s lawyers can therefore say whether their clients admit or deny the terror charges or otherwise make a statement. TV4 Nyheterna has searched for the defenders.

  • Lawyer Nils Svantemark: I can’t go into anything right now, it’s a no-go. I can state that the proof requirement to arrest and possibly detain is far lower than to finally be convicted of something. We will see what the investigation shows, but everything about the investigation is confidential.

  • Lawyer Slobodan Jovicic: I have a curfew. So what I can say is that I can confirm that I received the appointment. That’s as far as I can go, that I got the assignment. It is a ban on yipping and then what is said must stop. We have received this under the premise that it is secret.

  • Lawyer David Massi: I will not comment on that matter at all. I choose not to comment on anything at this time.

  • Lawyer Jonas Granfelt: I cannot answer any questions at this stage. This is, among other things, due to the yipping ban. It is my position that I cannot comment on anything at this time.

  • According to the Public Prosecutor’s Office’s website, it is unusual to decide on a ban on smoking during the preliminary investigation stage. Breaking the covenant can mean being convicted of a crime and punished.

Säpo states that an intensive investigation is underway and that several seizures are being analyzed. No later than 12 o’clock on Sunday, the prosecutor has to request the IS terror suspects detained.

Facts: Prohibition on spoofing during the criminal investigation

Even if there is pre-trial confidentiality in a criminal investigation, the confidentiality does not extend to persons other than the public officials, which means that, among other things, witnesses can tell about the interrogations in which they have participated.

Prosecutors have the right to decide on a ban on speaking during police interrogations. This means that even the categories of persons who are not normally covered by confidentiality, for example witnesses and lawyers, are prohibited from telling about what has come to light during the interrogation. A non-disclosure ban applies only to the persons present at the interrogation and only covers the information that comes out during the interrogation.

If the prosecutor has decided on a whistle-blowing ban, the freedom of communication for the public officials covered by the ban ends.

When is a yipping ban used?

No statistics are kept on decisions on bans on yipping, neither bans on yipping during preliminary investigation nor bans on yipping in court.

The cases where the courts decide on bans on yipping are mainly about very serious crime; complicated and serious crimes with great mass media interest. It is unusual for prosecutors to decide on bans during the investigation stage.
