justice puts temporary brake on Milei’s labor reforms

Argentina Milei inaugurated president the country in crisis expects ultraliberal

First setback for the new president, the ultraliberal Javier Milei: this Wednesday, the courts blocked labor law reforms contained in his “mega-decree” intended to deregulate the country’s economy, which is going through a serious economic crisis, with inflation of 160% over one year.

On December 20, barely ten days after coming to power, Javier Milei announced a mega decree organizing a massive deregulation of the economy: he modified or repealed more than 300 standards on, among other things, work, price and rent controls. , privatization of companies.

Technically, it has already entered into force, although it is expected to pass through parliament later. The opposition did not wait: dozens of legal actions were filed, including that last week of the CGT, the largest trade union in the country, which referred the matter to the National Chamber of Labor. And it is this chamber which has just delivered its verdict: it suspends the provisions of the “Work” chapter of the decree, which provides for an extension of the trial period from 3 to 8 months, a reduction in compensation in the event of dismissal , limits to the right to strike.

The judges believe that this notion of urgency invoked by the president to avoid going through Parliament does not appear to them, especially since certain aspects of the decree “ have a repressive or punitive nature “. This suspension is provisional, pending a substantive legislative review. But the government has already announced that it will appeal.
