The Supreme Court will examine whether the police may search for electronic data that is stored on external servers or in cloud-based online services, even if the information may be stored abroad, writes HD in a press release.

The decision to examine the issue was made in plenary, that is, all 16 members of the judiciary participated in the decision.

It is in a case concerning money laundering where the suspect appealed a decision in the Court of Appeal to remotely search his computers and phones. When the decision was appealed, the search was already complete.

HD does not usually review decisions that have been implemented, but HD believes that there is a great need for guidance.

“I welcome that the Supreme Court has decided to examine this important issue. More and more communication takes place via the internet, and in order to prosecute crimes, police and prosecutors must have access to electronic information,” says Attorney General Petra Lundh in a press release.
