Defense still awaiting relevant disclosure in teens manslaughter case

The wait for disclosure continues in the case of a teen charged with manslaughter in the death of a 45-year-old man.

The case of 15-year-old accused, who can’t be identified under the Youth Criminal Justice Act (YCJA), was up briefly in court in Chatham Monday.

“I continue to wait for very relevant disclosure,” defense lawyer Greg McGivern told court.

Noting he has written the Crown about the issue, McGivern made a request to set a pre-trial.

“I think that will be helpful in moving the matter forward,” he said.

The judicial pre-trial will be held May 9 followed by the youth returning to court May 29 for instructions following the pre-trial.

There is a publication ban on evidence heard during the pre-trial phase.

According to previous reports, the accused, then 14, originally was charged with aggravated assault after a man was seriously hurt in a clash at Queen and Louise streets in Tilbury on June 6, 2022, police said.

The injured man, identified in court documents as William Walker Grant, died in hospital June 27.

The youth was arrested again on July 14, 2022, and charged with manslaughter, police said.

In November 2022, the Crown told court it had applied to the attorney general to have the accused found liable as an adult and sentenced as an adult if convicted. The application, under the YCLA’s Section 64requires the attorney general to give notice before evidence is called or a plea entered.
