Next Thursday, the Constitutional Council will decide and say whether the Asylum and Immigration law, adopted a month ago by Parliament, is consistent with the Constitution or not. Some measurements could be censored. A collective of state agents is warning about the consequences of one of the most controversial aspects: national preference measures, that is to say the tightening of access to social benefits for foreigners. According to its estimates, at least 110,000 people risk falling into deep poverty.

If the law is promulgated as it is was adopted by Parliamentalmost all social benefits, such as family allowances or housing assistance, will be conditional on a period of presence in the territory of at least five years or on a minimum duration of professional activity.

The “Our public services” collective has done the calculation. At least 110,000 people, including 30,000 children, will be deprived of their social rights, “ for the sole reason that they were not born in France or that their parents are not French “.

This is a low range, warn the authors of this note. This calculation only includes families with two foreign spouses. If we add single-parent families or mixed couples, we can reach 700,000 people.

This study, the conclusions of which were transmitted to the Constitutional Council, also underlines that the people concerned are often already in precarious situations. This law could therefore push them into poverty, or even extreme poverty.

The Wise Men will now have to say whether this break in equality, between French people and foreigners, and between active foreigners and inactive foreigners, is consistent with the Constitution.
