A wanted man a Sarnia police dog found hiding in an attic of a Maxwell Street home got bail about three weeks later, but is back in jail again after police said he broke the rules of his release.

A warrant also has been issued for Brandon Waters’ surety, police said.

Police first received information on Sept. 25 around 10 pm that Waters was inside a home in the 400 block of Maxwell Street, between Lydia and East streets. The 38-year-old Sarnia resident had avoided arrest on two previous occasions, police said.

Officers contained the area that Wednesday and shortly before midnight police entered the home and a police dog found Waters in the attic. He was arrested on eight counts of breaking and entering, two counts of mischief, and one count of theft valued at less than $5,000. He was held for lease, police said.

Waters got bail on Oct. 17. He had a curfew from 11 pm to 6 am and was supposed to be living with his surety, James Steele. However, when members of the Sarnia police offender management taskforce went to the address Steele gave in court several hours after Waters’ release, he wasn’t there. They also learned Steele, 49, moved out a year earlier.

An arrest warrant was issued for Waters on two new counts of breaching lease. Police saw him on Oct. 25, but he allegedly kicked a police cruiser door, striking one of the officers, and tried to flee on a bicycle, police said.

He eventually was arrested and charged with two additional counts of assaulting police and resisting arrest and was held for bail, they said.

Waters made a brief appearance in court Friday by video link from the Sarnia Jail. All of his charges were adjourned to Nov. 15.

Waters also is facing three counts of possessing stolen property, including one for property valued at more than $5,000, after a stolen vehicle was involved in a hit-and-run crash earlier this summer.

Waters previously spent 19 days in jail in 2018 for skating away on inline skates with a stolen patio table.
