Utrecht presents bakers with a crompouce dilemma pay or stop

Experts from the Netherlands Patent Center, part of the Netherlands Enterprise Agency (RVO), say that a patent (also called a patent) is not appropriate for this product, because it is not a technical innovation. Applying for a brand name is possible, and has happened. The brand owner can take action against people who use the brand name without a license.

The design right has also been applied for and granted to Bammetje Bakery. That’s about the appearance, the aesthetics. If the creator is also given this right, you may not call the product anything else and still sell it.

The trademark right holder can ultimately point this out to the person who infringes the intellectual property right. But bakers do not have to wait for a letter, but can also proactively contact Bammetje Bakery for a license. Ultimately, bakers may be forced into court to pay damages and/or remove the product from the shelves. That also depends on the requirement.
