The US Supreme Court justices have ruled 6-3 that the former President is entitled to immunity from prosecution for his official actions, but that immunity does not apply to his private conduct.

“We conclude that under our constitutional structure of separation of powers, the nature of presidential power requires that a former president enjoy partial immunity from criminal prosecution for official acts during his term in office,” Chief Justice John Roberts wrote in the decision.

On the other hand, Robert stated that the US President is not above the law, and said, “The President does not have immunity for his unofficial actions and everything he does is unofficial. The President is not above the law.”

Robert stated that they will send the decision to the lower district federal court and shared the information, “Accordingly, we are sending it to the District Court to determine in the first place whether Trump’s behavior in this area will be characterized as official or unofficial.”

The Supreme Court’s decision has prompted comments that Trump will be exempt from the charges, which will require additional briefings and hearings to determine which charges he will be exempt from, and will further delay the trial date.

Trump, who was sued on charges of his role in the January 6 Congress raid and interference in the 2020 Presidential elections, applied to the Supreme Court to annul the case, arguing that the actions he committed while in office fell within the scope of “Presidential immunity”.
