(Finance) – The crackdown on illegal work on construction sites is coming: the sanctions in the event of a negative outcome of the verification of the adequacy of the workforce will be triggered for all public contracts and for jobs worth 70 thousand euros in the private sector. This is what the draft Labor Decree provides.
For public procurement the threshold of 150 thousand euros is eliminated: in case of violation, the project manager can be reported to the Anac. In private contracts the threshold drops from 500 thousand to 70 thousand euros, the value of a home renovation: in the event of a negative verification, a fine of 1,000 to 5,000 euros is imposed for the client.
The rule changes as provided for by the latest Pnrr decree, which establishes, for public and private contracts for the construction works, that, before proceeding with the final settlement of the works, the project manager, in public contracts, and the client, in private contracts , verify the adequacy of the impact of manpower on the overall work.
For public procurement, in the absence of a positive outcome of the verification or prior regularization of the position by the company entrusted with the works, the violation is reported to the Anac for the purposes of evaluating the performance of the project manager.
