Former President of the United States Donald Trump invoked his right to free speech on Monday after prosecutors asked a judge to limit information Trump can publicly discuss related to the latest charges against him.

– I should not have been placed under a restraining order, because it would violate my right to freedom of speech, Trump wrote on his own Truth Social platform.

Special Prosecutor Jack Smith filed a motion Friday night asking a federal judge to bar the former president from releasing evidentiary details of the case. The motion concerns charges brought against Trump last week related to his efforts to overturn the outcome of the 2020 presidential election.

According to Trump, such a restriction would affect his freedom of speech. His lawyers also appealed on Monday that the restriction violates the freedom of speech guaranteed by the constitution.

Social media writing in the background of restriction

Prosecutors appealed to a federal judge Tanya Chutkania to restrict information after Trump wrote on social media on Friday that he would go after those who would harass him.

– Such a restriction is particularly important in this case, because the accused has previously published public statements on social media regarding witnesses, judges, lawyers and others related to legal cases pending against him, the prosecutors stated.

Trump has repeatedly called for Chutkan to recuse himself from the trial. Trump’s predecessor Barack Obama appointed him to the post.
