The war in South Darfur justifies the granting of asylum

On Monday, the National Court of Asylum (CNDA), a specialized French administrative court, announced that it would allow nationals of South Darfur, a region badly affected by the war, to benefit from the right of asylum.

It was by rendering a decision favorable to the “benefit of subsidiary protection provided for by European law” for a Sudanese originating from Khireyga that the CNDA set a precedent. And since this type of decision by the CNDA, which rules on appeal on asylum requests, sets a precedent for all similar cases, the nationals of the South Darfur can obtain asylum in France.

The applicant man had requested asylum and alleged fears towards the authorities of his country due to his belonging to the Dadjo ethnic group and the political opinions allegedly attributed to him. Insufficient elements for justice which however granted asylum because of the region from which the man came.

To justify its decision, the Court declared that Sudanthe South Darfur region was facing a “ situation of blind violence » as it opens the way to the protection of its nationals for asylum in France, specifies the press release from the National Court of Asylum. The Court considered that this person ran a real risk of serious threat to his person or life if he returned to his State of origin, as a civilian.

Since April 15, the date of the start of the war between Sudanese soldiers and paramilitaries, several regions of the country, including South Darfur, have experienced a situation of exceptionally intense violence. Moreover, tribal violence took place today in South Darfur, between two armed tribes belonging to the rapid support forces. According to local sources, the clashes left dozens of victims.
