It was in October last year that the 21-year-old was executed during a car journey in the Björk Tunnel in Stockholm, according to the verdict. In the middle of rush hour traffic, the man had been shot with four shots in the head at close range by the now convicted 19-year-old.
Crown witness
He was sentenced about a month ago to 10.5 years in prison for murder and aggravated weapons offense by the Södertörn district court.
The penalty was 16 years in prison, but the 19-year-old received a reduced sentence because he cooperated with the police and contributed information regarding another murder. He is thus a crown witness.
Appealed to the Svea Court of Appeal
But neither party is satisfied with the outcome of the verdict. Prosecutor Daniel Jonsson has submitted an appeal and wants the 19-year-old to be sentenced to 12 years in prison.
But that assumes that the 19-year-old continues to cooperate in the second murder investigation. If he doesn’t do that, he will be sentenced to 18 years in prison, says Jonsson.
The 19-year-old: Shot in self-defense
The 19-year-old’s lawyer, Sargon De Basso, is also appealing the sentence and wants his client to be released in the first place. Alternatively, he insists that the deed be labeled differently.
The 19-year-old himself has denied any crime and claimed that the 21-year-old threatened him with the revolver. The 18-year-old then allegedly managed to take the weapon from the man and then shot him in self-defense.
But the plaintiff’s counsel Håkan Andersson writes in his appeal that it is an afterthought construction that is adapted to the investigation.
In his appeal, he writes that the penalty for the murder is 18 years and can be reduced by a maximum of four years because he is a Crown witness.
