A man was sentenced to eight years in prison for, among other things, aggravated rape of a child and aggravated sexual abuse of a child. The National Prosecutor (RÅ) now wants one of the assaults that the Court of Appeal considered to be aggravated sexual assault to be classified as aggravated rape instead, and is appealing to the Supreme Court.

“In my opinion, it is important for the management of law enforcement that HD examines whether the sexual act involves such a serious violation that it is comparable to sexual intercourse,” says Attorney General Petra Lundh, according to a press release.

The District Court considered that the abuse in question constituted aggravated rape against a child, but the Court of Appeal held that it did not because it did not involve contact with the child’s genitals.

However, Rå believes that the man’s abuse is so serious that it is comparable to sexual intercourse, and that the crime should be assessed as aggravated rape against a child.

RÅ further believes that the man should receive a significantly harsher punishment.
