The Court of Appeal changes the sentence for a woman whom the district court previously sentenced to one year in prison for four cases of fraud, including the high-profile bill in Malmö last year.
The woman will now avoid prison and will instead be sentenced to probation and community service for 140 hours.
The Court of Appeal’s reasoning is that the frauds should not be considered serious. They also believe that the evidence suggests that the woman was not involved in a specific plan to commit crimes. She is also fully acquitted of a charge of fraud.
It was on Christmas Day last year that a group of 35 people ate and drank at the Atmosfär restaurant in Malmö. The bill landed at SEK 82,157, but the guests left the restaurant without anyone paying.
Five people were sentenced to prison for between one and two years for several cases of serious fraud. Three of these appealed the verdict, but only the woman’s appeal was approved.
