The police will not start a preliminary investigation into the

The police states that there is no basis in the legislation for the warning given to the employee to be confidential information.

Last season’s head coach of the Kuopio Palloseura women’s team Pauliina Miettinen the criminal report made does not lead to a preliminary investigation. The police have finished investigating the matter.

Miettinen said a couple of weeks ago that he filed a criminal complaint against KuPS. According to Miettinen, KuPS had leaked confidential information to Savon Sanomat, which has caused harm to his reputation and career.

The decision to close the investigation was made by the crime commissioner Esko Salo. He states in the decision that, according to his understanding, the contract between the coach and the club complies with the Employment Contracts Act, and there is no known legal provision on the basis of which a warning to an employee would be confidential information.

In addition, the police are not aware that the contract between Miettinen and the Kuopio Palloseura has separately agreed on matters that may be kept secret.

The police also evaluates the matter from the point of view of defamation

Crime Commissioner Salo states in his decision that, according to his understanding, the case only involves the assessment of whether someone has committed defamation. Defamation would require, according to the criminal law, that false information or insinuations are presented about another person in such a way that the act is apt to cause damage or suffering to the injured person or contempt towards him.

However, criticism directed at a procedure in politics, business life, public office or task, science, art or similar public activities and which does not clearly exceed what can be considered acceptable is not considered defamation.

Since Miettinen has been given a written warning, it cannot be false information or innuendo. Salo states that, based on the available material, there is no reason to suspect that the purpose was to denigrate Miettinen, when information about the warning given has been shared with the media.

Salo states that Miettinen’s position as the women’s head coach can be considered an area of public activity where a greater tolerance for public criticism than usual can be required.

He was the first to tell about the conclusion of the investigation Savon Sanomat.
