In December last year, a one-year-old girl died in connection with a car accident on the E14, south of Brunflo. A police investigation showed that the mother who drove the car was under the influence of both alcohol and drugs. And that the child was not strapped into his car seat.
The woman is now sentenced to one year in prison for aggravated drunk driving, causing another person’s death, aggravated illegal driving, and minor drug offenses. She must also pay damages to the child’s father of SEK 30,000.
The defense considered that the woman should be acquitted as she felt compelled to take the car to avoid an attack and that the woman thus exercised the right of self-defense. The district court does not agree but makes the assessment that the woman and the child were in their home without any signs of acute danger.
The court also considers that if the woman was in acute danger, she had other options for action than driving drunk.
