The hunt for piracy continues! Following a new court decision, Internet service providers will have to block around fifty sites illegally offering content for downloading or streaming in a few days.

Bad times for fans of illegal downloading and streaming: just a few weeks after a large-scale measure (see our article), a new court decision dating from April 4, 2024 imposes on the main French Internet access providers (Bouygues Telecom , Free, Orange and SFR) to block around fifty sites offering pirated content (films, series, music, software, games, etc.) for download or streaming. This new measure from the Paris Judicial Court (see the full text of decision RG no. 24/02432) follows a subpoena dated February 8, 2024 from several audiovisual production companies and organizations defending rights holders, such as the National Federation of Film Editors (FNEF), the Union of Cinema Producers (UPC), the Digital Video Publishing Union (SEVN), the Association of Independent Producers (API), the National Center for Cinema and Animated Images (CNCIA) but also Gaumont and Disney.

Relayed on ISPs therefore have until April 18 to block access to banned sites for their subscribers. It should be noted that the measure only concerns the four major French ISPs mentioned above: other Internet service providers do not seem to a priori not affected by this decision, any more than the mobile telephone operators, even though they also offer Internet access…

This new list completes the long series published in March. The big difference is that this time it includes many purely French-speaking sites, notably the very popular Tirexo, Zone-Telechargement and other Extreme-down, which are all copies of the famous Wawacity, also banned, in addition to other well-known platforms like YggTorrent or Cpasbien. Curiously, there is still no trace of more recent but very popular sites like Darkino or Flixcord (see our article on direct download sites), which escape the wrath of justice, at least for the moment.

Like other decisions of the same type, the decision must apply to all subscribers on French territory, “including in the overseas departments or regions as well as in the Wallis and Futuna Islands, in New Caledonia and in the French Southern and Antarctic Lands”. It specifies that operators must carry out this blocking “by any means consistent with the degree of effectiveness required by Directive 2001/29/EC, and in particular by blocking domain names and consequently all associated subdomains.”

And that is the problem, and the limit of this type of measurement. First, because the text of the court decision explicitly gives the exact list of domain names concerned, which is as follows:

The trouble is that this beautiful list also gives in plain text all the addresses (URLs) of the pirate sites and their various mirrors. Not very smart, because it allows anyone to access these famous sites, as long as the operators have not yet implemented their blocking measures.

But it’s a safe bet that these URLs are still accessible after blocking! Because, most often, ISPs are content to place these addresses on blacklists, by banning them from their DNS servers, these directories which make the link between “understandable” site names and their real IP addresses, which correspond to the servers that host them. However, as we explain in our article, it is very simple to change DNS servers. It is a quick, reversible, safe and, what is more, perfectly legal operation. In fact, by modifying a few settings on their computer or mobile device, any Internet user tempted by the adventure will still be able to access banned sites and domains, even after blocking by their operator….

In addition, as all these pirate sites have been the subject of this type of measure for a long time, they all have the habit of regularly changing their URL, to escape radars and blocks. And it is very likely that they will do the same from April 18, taking new domain names. In short, it’s an eternal game of cats and mice, which, if it keeps away “tourists” unaccustomed to frequenting this kind of platforms, will not prevent regular users from continuing to benefit from all this illegal content. .
