The government receives an investigation into tougher penalties

Minister of Justice Gunnar Strömmer (M) has received a new investigation into tougher penalties.
Among other things, the investigator proposes a new indefinite so-called security sentence for criminals who are a danger to society.
– This will be able to attack serial rapists, serious forms of partner violence and gang crime, says the special investigator

The security sentence is intended for “particularly serious situations of recurrence or particularly serious serial crime and where there is a significant risk of recurrence of such crime”.

The sentence is not time-bound, but it will be up to the courts to set a minimum term equivalent to the sentence that would otherwise be imposed.

Proposed to be introduced in 2028

The minimum sentence is proposed to be four to six years in prison, with a maximum of between ten and twenty-four years.

In special cases, it must be possible to extend the maximum period by a further three years after a special examination.

The new penalty is proposed to be introduced in 2028.

Disagree with the Tidö parties

The investigator further disagrees with the Tidö parties’ proposal to criminalize running away and to introduce a stay ban as a new punishment.

The proposals in the report will be sent for referral to get opinions from authorities and organizations.

The government will then decide which proposals they want to proceed with.

Security sentence for an indefinite period of time for criminals dangerous to society with a high risk of recidivism.

The probationary period for parole is extended from at least one to at least two years.

No new parole for remaining sentence if recidivism occurs while on parole.

Conditional release must, as a rule, be supervised.

Option to serve prison sentence with electronic monitoring in controlled housing for up to one and a half years.

Option to serve prison sentence with electronic foot shackle for up to nine months.

Participation in recidivism prevention measures must be taken into account when considering prison leave.

The scope of use of probation in combination with imprisonment must be expanded.

Rules in the Criminal Code that are applicable in the event of recidivism must be tightened.
