“The Justice Department’s view that the Constitution prevents the impeachment and prosecution of a sitting president is absolute and does not depend on the seriousness of the crimes charged, the strength of the government’s evidence, or the merits of the prosecution, which the office fully supports,” Smith wrote.
The charges were dismissed in November
