the Council of State opposes their systematic ban

It is up to the prefects, and them alone, to decide whether a demonstration in support of the Palestinian people can take place in France. This is what the Council of State has just recalled this Wednesday, October 18. The Council of State reminds, in passing, the right to Gérald Darmanin.

In a telegram sent last Thursday, October 12, to the prefects, Gérald Darmanin ordered that all pro-Palestinian demonstrations without distinction be systematically banned.

However, recalls the Council of State, it is not up to the minister to make this decision, but to the prefects who must assess “ on a case-by-case basis, if the risk of disturbances to public order » is real. And this, regardless of the side defended by the demonstrators.

Legally, we cannot prevent people from gathering for the sole reason that they support the Palestinian population, further specifies the highest French administrative court.

On the other hand, the demonstrations in favor of Hamas or which would justify the terrorist attacks of October 7 are indeed likely to disturb public order, judges the Council of State.

As soon as this decision was published, associations, unions and the NPA, a far-left party, called for rallies this Thursday in Paris, at the end of the day to support the Palestinian people.
