There is no flaw in the calling of the early legislative elections scheduled for June 30 and July 7. The Constitutional Council rejected, this Thursday, June 20, ten appeals which contested the decree signed by Emmanuel Macron, judging the deadlines in accordance with the fundamental law. After the dissolution of the National Assembly, several appeals were filed to protest against the dates of the legislative elections within a time frame considered too short and likely to “seriously undermine the sincerity of the vote”.
According to article 12 of the Constitution, “general elections take place at least twenty days and forty days at most after the dissolution”. For the Constitutional Council, this deadline is respected, including for 24-hour early elections in overseas territories.
“The President of the Republic pronounced the dissolution of the National Assembly by a decree of June 9, 2024 which took effect on the same day. Therefore, setting June 30, 2024 or, by derogation, June 29, the date of the first round of voting, the contested provisions implemented, without ignoring it, article 12 of the Constitution”, indicate the Sages.
The Constitutional Council also rejects arguments on the risks of undermining the sincerity of the vote or on the fact that the election takes place based on the electoral lists drawn up on the date of the decree of June 9.
