But for the rest, in broad outline, and in particular concerning the postponement of the legal age to 64, the bulk of the project is approved. The idea of a referendum brought to the left is also rejected.

The French Constitutional Council has validated most of the pension reform, including the postponement of the legal retirement age from 62 to 64 years. This measure will therefore have the force of law as soon as Emmanuel Macron has promulgated the text, including six secondary provisions which, on the other hand, have been rejected.
These “social riders” had no place in the statute referred “, which is for its part of a financial nature, consider the Sages. This is particularly the case of the index on the employment of seniors, which was to be compulsory from this year for companies with more than 1,000 employees.
Also censored: the CDI seniors, which was to facilitate the hiring of long-term job seekers over 60 years old. The Council does not comment on the advisability of such measures, but judges that they have no place in a bill rectifying the finances of the Sécu, because without or little effect on the receipts.
In the same spirit, the venerable institution also considered that the cancellation of the transfer of the collection of contributions from Agirc-Arrco to Urssaf could not be included in such a project. Provisions relating to advantages for active categories such as the police have also been challenged.
The Elders were also invited to consider a request for a referendum of shared initiative (RIP) filed by the left on the subject of pensions. A second request, filed later, must still be the subject of a new decision on May 3. Until then, the first request is rejected.
