Texas and 15 other Republican-led states have challenged the president Joe Biden to the right of the immigration program.
The program gives people who entered the country without authorization who are married to a US citizen the right to apply for permanent residency in the United States.
An estimated 500,000 people could get a work permit in the United States thanks to the program.
The state of Texas says the program is unconstitutional and exacerbates the immigration crisis at the US southern border.
