On Sunday, an action group carried out a demonstration by swimming in the water just outside the properties that have the address Drakskeppsvägen in Viggbyholm, Täby. The bathing also took place from one of the bridges that the County Administrative Board found to be a black building, a decision that was appealed to the Land and Environment Court. At the far end of the privately owned jetty there is a landing place for a helicopter.

The purpose of the action was to protest against the illegal privatization of municipal land in the area by a number of property owners, information that the newspaper ETC published last week.

According to Jenny Gibson, community development manager at Täby municipality, it is a simplified picture of the situation:

– In the detailed plans that apply to the area, it is reported that the properties have a border directly on the water and that there is no public land in between. The municipality has also long since assessed that beach protection in the area has been abolished, she says.

The situation is described however, as “complex”. Now the municipality, after the attention the matter attracted during the past weekend, will start the supervision it decided on in November last year. On Monday, Täby municipality received many questions about the case – both from the affected property owners and from citizens in the municipality who want to know what applies.

– Most of the properties along the route are over a hundred years old. Some have easements or other types of rights, both in terms of land and water. As for the bridges, there are those that have been around for a very long time while others have been modified over the years. Each property has completely different conditions and must be assessed separately, says Jenny Gibson.

According to her, the uncertainty is exacerbated due to the fact that the property boundaries are not determined in modern times:

– There may be differences with the boundaries reported in public map systems and the shoreline that exists today. It can be about land elevations, about water levels and that there have been various forms of backfilling. To ensure how the property boundaries go, property determination can be carried out through the surveying authority, Jenny Gibson continues.

In the supervisory matter comes the municipality to look at the beach protection issue and the building permit issues regarding the facilities that are in the water, which is the municipality’s.

– We will also go through property by property as to what applies. It is in everyone’s interest to clarify the legal issue, says Jenny Gibson.

Why have you not acted before?

– Normally we handle this type of case in turn. After the attention this has attracted, we must prioritize it, Jenny Gibson answers.

With regard to the two bridges, one of which has an associated helicopter plate, the County Administrative Board decided in February this year that they should be removed as there is no building permit or other permit to build it. The decision has been appealed to the Land and Environment Court, which has not yet made a decision in the case.
