The man admitted that he was holding the gun when a fatal shot was fired at a young man in Jakobsberg northwest of Stockholm, but claimed that he did not mean to shoot. Now the 19-year-old is acquitted of murder by the Svea Court of Appeal.
In the district court he was sentenced to 16 years in prison for murder, now he is sentenced instead to six years in prison for causing the death of another, a serious crime.
The shot was fired in connection with a physical confrontation between the two, and according to the Court of Appeal, it cannot be ruled out that it was unintentional. That it was actually as the man has described appears to be “practically possible”, writes the court.
There are also a number of circumstances, according to the court, which speak against him having the intention to kill, including the location of the shot and the fact that it was only a question of one shot.
Three other people were also charged with murder. Just as in the district court, the Court of Appeal acquits them on that point.
According to the police, the incident is connected to conflicts between criminal networks.
