(Finance) – “The confrontation between the political decision-maker and the professional orders, which will be increasingly involved in the management of the seized and confiscated companies, is an important opportunity to lay the foundations for an overall reform of the legislation which sees the problem of stability employment of the employees of these companies increasingly at the center of political attention”. The Senator said so Sergio Rastrelli (FdI), member of the Justice Commission at Palazzo Madama, during the conference “Seized and confiscated companies: labor law aspects” promoted by theOrder of Chartered Accountants and Accounting Experts of Napleschaired by Eraldo Turi.
The importance of the topic addressed was reaffirmed by Livia DeGennaro (judge of the Third Civil Section of the Naples Business Court): “The protection of the workers of seized companies it requires a reconciliation between public and private law needs, a circumstance that highlights the various extremely delicate issues. Business continuity takes on an ever more significant aspect, with the protection of the workforce that judicial administrators and delegated judges are called to keep in mind, carrying out dispositional acts, when they administer companies affected by seizure orders”.
At work, coordinated by Angela LaBattaglia (Vice-President of Odcec of Naples), Bruno Anastasio (President of the Labor Commission of the Neapolitan Order) underlined that “the need for discussion to exercise the professional activity effectively and efficiently and to provide useful elements to avoid errors and risks associated with the incorrect use of some legal instruments”.
Second Vincent Calvin (scientific coordinator of the Employment Commission) “the issue has important repercussions for how one must proceed in the sphere of labor relations in seized or confiscated companies. Very often they are illegal relationships with undeclared workers and therefore it is good to also address the issues relating to illegal hiring and other criminal phenomena in order to have a broad and complete vision of the difficult role of the judicial administrator”.
Marco D’Orsona Bucci (accountant of the Odcec of Lanciano): “As regards article 603 bis, one of the critical issues is the correct application of the national collective labor agreement and the reform of the same article has made it more widely applicable. The goal is to provide the maximum possible information to give useful professional ideas for the management of this complex matter”.
