Donald Trump “resorted to criminal means” to retain the presidency after losing the 2020 election.
The new charges come from special counsel Jack Smith, who does not want the former US president to be able to claim immunity for his actions after the 2020 presidential election.
Smith on Wednesday filed a brief with the court deciding the case in which Trump is accused of trying to have the results of the 2020 election overturned.
“Despite the fact that the defendant was sitting president during the time the indictment applies, his actions were fundamentally private,” write the prosecutors.
If Trump is convicted, he risks a maximum of 20 years in prison.
