In January, SVT Nyheter Skåne reported that the Swedish Tax Agency has stopped payments of square deductions of more than SEK 1.5 million to the Malmö brothers’ garden company.
These are the companies Lomma trädgård (which has changed its name to MSA Service Entreprenad Skötsel AB), Bosab (which has changed its name to FMAS Anläggning Snickeri Service AB), Gröna teamet and Mitt trädgård.
Behind the companies are six brothers from Malmö that SVT Nyheter Skåne has reviewed in several reports.
Pocket garden appealed – do not get it right
The box deductions entitle companies to payments of 50 percent of the labor cost.
– We have found more systematic and repeated errors. They have applied for payments for jobs that have not been done or for an excessive amount. In some cases, the company has not been able to tell what they have done for work on the customer’s site, said Pia Blank Thörnroos, tax lawyer at the Swedish Tax Agency, to SVT in January.
Lomma Trädgård appealed several decisions from the Swedish Tax Agency. In a letter to the administrative court, Lomma garden writes, among other things, that the customers’ information to the Swedish Tax Agency is “totally incorrect” and that they are entitled to the requested amounts.
Gives the Swedish Tax Agency the right
In six different judgments, the Administrative Court has now rejected Lomma Garden’s appeals and ruled in favor of the Swedish Tax Agency.
In a few cases, Lomma garden has sent the correct documentation to the Swedish Tax Agency during the proceedings in the administrative court. Those cases have been written off and sent back to the Swedish Tax Agency.
