(Finance) – From October 1, 2024, businesses and self-employed workers that operate in the shipyards will have to adapt to a new regulation: the so-called “credit license“. This system, introduced by the Legislative Decree No. 19/2024aims at improve safety in the workplace and to combat irregular work, but there are already concerns about the short timeframes for compliance.
The new credit licence will apply to all businesses and self-employed workers working on temporary or mobile construction sites. These include construction, demolition, renovation, maintenance, and much more. In practice, this is anyone who deals with fixed or temporary workssuch as buildings made of masonry, reinforced concrete, metal, wood, as well as infrastructure such as roads, railways, electrical systems and hydraulic works.
To obtain the license, you will need to apply through the portal of theNational Labour Inspectorate. The request can be made by the legal representative of the company or by the self-employed worker. Even if there are delays in issuing the license, companies will still be able to continue operating on construction sites.
To apply, you will need to provide some documents, including: aself-certification of registration at the Chamber of Commerce (Chamber of Commerce), the DURC (document of regular contributions) and the DURF (tax document). A declaration which certifies that the training obligations on workplace safety have been respected, possession of the Risk Assessment Document (DVR), and thethe appointment of the service manager has taken place prevention and protection, where required by law. If the documents or information provided are found to be false, the license will be revoked for one year.
At the heart of this new system is the Credit Managementa mechanism that will evaluate companies based on various parameters. Each company or self-employed worker will have a maximum of 100 credits: 30 credits will be assigned when the license is issued, 30 credits will be linked to the company’s history (based on the date of registration in the Company Register) and 40 additional credits will be assigned to companies that invest in safety or carry out training activities. This system is designed to incentivize businesses to invest in safety, but credits can also be deducted for violations or defaults.
In case they happen serious accidents at work attributable to the employer, the license can be suspended for up to 12 monthsdepending on the severity of the violation. If the credits are deducted, it will be possible to recover up to 15 by participating in safety training courses or making specific investments. The recovery of the credits will be assessed by a territorial commission composed of representatives of INAIL and the National Labor Inspectorate.
Even though the regulation will come into force next October, further clarifications and indications are awaited by the National Labor Inspectorate, which will have to issue an explanatory circular and activate the platform for requesting the license. This will give companies time to prepare and adapt to the new system.
