Communication access agreements are subject to the approval and regulation, if necessary, of BTK, the regulatory and supervisory authority. This is not the first time that an operator in Turkey has not openly implemented BTK’s Board Decision. Monopolistic mentality that is disturbed by the affordable service we offer to citizens; By blocking communication, it acts contrary to Article 22 of the Constitution, Article 124/1 of the Turkish Penal Code and BTK legislation. The relevant operator has the obligation to provide base station services to virtual mobile operators in the concession agreement. We would like to remind you that in accordance with the BTK Administrative Sanctions Regulation, the relevant operator must be ensured to comply with the legal order through administrative fines due to this seriously faulty action that violates public order, otherwise his authorization must be terminated/cancelled in line with BTK legislation. The relevant operator requested an exorbitant increase in the price determined by BTK for the base station service due to the rapid increase in the number of our company’s subscribers. As a result of different conciliation processes carried out under the supervision of BTK, three separate Board Decisions were made. The process was concluded with the Board Decision dated 25.10.2024 and numbered 2024/UK-ETD/412 and the decisions regarding the fee increase to continue providing base station access service to Netgsm’s existing and new subscribers. The Board Decisions in question were notified only to the addressees.
It should not be forgotten that in order for the communications sector in our country to have an effective free market, new mobile operators such as Netgsm must enter the sector, otherwise our citizens will be forced to submit to high prices.
