David Ambrose Lozon, 59, was released after appearing Tuesday in a Chatham court, where the Crown withdrew the first-degree murder charge in the death of Louise Thomson, 27.

Assistant Crown attorney Colleen Johnson told court there was no reasonable prospect of a conviction on the murder count, but Lozon remains charged with committing an indignity to a body and faces a new count of accessories after the fact to murder.

Lozon’s lawyer, Greg McGivern, obtained a publication ban on evidence heard regarding the two charges his client now faces.

There is also a publication ban on all evidence heard during the pre-trial stage of the ongoing murder case.

Jeffrey Davis, 44, and Sky-Linn Holden, 23, are charged with first-degree murder and committing an indignity to a body in Thomson’s death. They remain in custody pending court appearances early next month.

According to previously published reports, Lozon and Davis were arrested June 4 and charged with first-degree murder after Thomson’s body was found at a William Street South address in Chatham.

Late that month, Holden was charged with first-degree murder and all three accused were charged with committing an indignity to a body, police said.

Despite Lozon’s long criminal record, the Crown agreed to a release order Tuesday, saying there was little risk to public safety. Lozon used a walker, appeared feeble and winced in pain at times during his appearance.

Lozon was released on his own recognition, but faces a $10,000 penalty if he violates release conditions, the order said. He must report weekly to police, may not leave Ontario, possess weapons or communicate with a long list of people.

He is to return to court Oct. 30.
