A new rule is in effect and it doesn’t just concern the quantity purchased.
Spain, its heat, its beaches but also its products cheaper than in France. Yes, bellota and manchego are more affordable than in France. But that’s not all. The kingdom is also popular for its low-cost cigarettes. And not just a little: generally half as much compared to France. But prices can be even lower and fall to 50 euros per carton, compared to 120 euros on the French side. Therefore, for residents living near the border, the calculation and choice are quickly made. Same with Luxembourg or Italy.
But the French knew it well: until recently, it was not possible to bring back more than one cartridge per person. Those who broke this rule were exposed to a fine if they were checked by customs. Now, the rules have been relaxed. Each adult present in a vehicle can bring back four cartridges from a foreign country member of the European Union. Therefore, the states neighboring France.
Therefore, the temptation to stock up is great, especially in the summer. Stock up for yourself, or for your loved ones. But be careful, there is a rule to follow scrupulously because it could result in a heavy fine if customs stops you.
Generally, when buying cartons of cigarettes for relatives, the reflex is to write the name of the recipient on them so that you can find your way around. However, doing so now exposes you to a fine. Indeed, the law only authorizes the purchase of these quantities for “one’s own needs”. These are defined based on 12 criteria.
Thus, “the existence on the products or their packaging of a sign designating, even implicitly, a recipient other than the holder” indicates that it cannot be a question of personal consumption. Customs will be entitled to seize your goods and issue you a fine. Before putting the cartridges in the trunk, you should therefore avoid writing the name of “Flo”, that friend to whom you promised cheap packets, or “Auntie Lulu” in marker.
In the event of a customs check, this exposes you to a fine of 100 to 750 euros as well as an additional financial penalty calculated from the excise and VAT due on the tobacco. And of course, with confiscation of the goods, regardless of whether the check was signed or not. So it is better to use your memory than to use the marker.
