“And you’re going to get more and more and more time,” Justice Mark Poland bailed him during a recent sentencing hearing.

Nap’s latest sentence, this time nearly nine months long, was for a series of drug-fueled crimes including wielding a hammer near a frightened older woman and causing extensive damage to her car before smashing the glass out of a bus shelter in front of 30 riders.

“The manner in which he was swinging the hammer showed blatant disregard for all those who were present, including some of the Sarnia Transit staff,” assistant Crown attorney Ian Maedel said, noting one staffer was helping an elderly rider at the time.

TheJan. 27 incident caused about $600 in damage to the Murphy Road bus shelter outside the Real Canadian Superstore. It was one of several erratic incidents in January to which Nap, 30, recently pleaded guilty, including causing a disturbance, breaching probation, theft worth less than $5,000, breaching a release order, two counts of mischief worth less than $5,000, and possession of a weapon – the hammer – for a dangerous purpose.

“Mr. Nap has an unenviable criminal record, to say the least,” Poland said.

Nap was sentenced in December 2016 to 18 months in jail for robbery and property damage. A few months earlier he hit a man, who was in the area trying to make a deal for a baseball hat, with a police-style baton twice in the back and fled with his cellphones, ID and gift cards, the court heard at the time. A couple of months before that he used a cordless phone and his fist to put holes in the wall of his grandparents’ home after being asked to do chores, something he was court-ordered to do if asked at the time.

In April 2021, Nap was convicted of assault causing bodily harm and was handed another 18-month sentence, the court has heard. Then, last year, he was convicted after trial of assault and sentenced to six months in jail. In March 2022, Nap pummeled a Sarnia man after taking offense to a comment he’d made to his partner.

A past pre-sentence report said Nap showed an inability to regulate his emotions. Defense lawyer Terry Brandon said during the recent hearing her client has struggled with a crystal meth addiction.

“I’m sorry,” Nap told the judge.

Along with the jail sentence, Poland ordered him to pay $600 for the bus shelter repairs and to stay away from the Superstore and the nearby bus shelter for the next three years. He also urged him to deal with his drug issue as that is the only way the public can be protected from his behavior.

The other way? More and more jail time, Poland said.

“It’s your choice,” he said.
