Preliminary hearing dates for Dec. 5 and Dec. 16 were set for Jared John Atwell in a Chatham court Thursday.

There is a publication ban on evidence heard during the pre-trail stage of Atwell’s case.

Kyle Wright-Morgan was shot around 1 am on April 30, 2023 in a clash near King and Fifth streets in downtown Chatham.

Atwell, 26, pleaded guilty to drug charges on Dec. 11, 2023 in connection with the shooting.

Police found seven grams of cocaine on Atwell when he was arrested. In a search warrant executed on May 1, 2023 at a locker used by Atwell, police also seized 26 tablets of LDS, 95 grams of cannabis and 5.5 grams of suspected cocaine. Police also seized $3,840, a knife, cellphone and personal identification.

Atwell was originally charged with possession of cocaine for the purposes of trafficking to which he pleaded not guilty. However, he was guilty of the lesser charge of simple possession of cocaine.

Atwell received a 150-day conditional sentence that included credit for time served for the 225 days he spent in pre-trial custody for the attempted murder charge.

Ontario Court Justice Paul Kowalyshyn agreed to a joint sentencing submission from the defense and Crown.
