In fact, it is clear that in the present case there are reasons of extreme urgency which, in line with the provisions of article 63, paragraph 2, letter c) of the public procurement code, justify a derogation from the tender procedure. The timing of a tender would risk excessively postponing the operation of the bridge in the riverbed, which has already been delayed by a good four years due to non-fulfilments not attributable to the contracting station.

The second, allow the design and execution of the related works through contract integrated based on the technical and economic feasibility project. This hypothesis is already contemplated by the regulations for the works of the Pnrr (Simplifications-bis decree, decree law 77/2021, art. 48, paragraph 5) and the draft of the new procurement code adopts it. The intention is to extend to the floodplain bridge of San Benedetto sul Po those simplified procedures which have been designed precisely for the most urgent and strategic works, such as those of the Pnrr, and which allow for an intervention to be carried out quickly and effectively which presupposes a high design capacity.
