TBS stands for posting and is a measure within Dutch criminal law that can be imposed by a judge on a suspect of a crime with at least four years in prison. When imposing TBS, the court must be convinced that someone was partially or completely unaccountable during the commitment of the crime. For example, due to a morbid disorder and/or a poor development. This can be personality disorders, addiction problems, traumas or a combination of these disorders.
There are two types of TBS: TBS with conditions and TBS with compulsory treatment. TBS with a condition is a slight form of TBS and patients often have more freedoms and rights than patients who have imposed TBS with compulsory treatment. TBS people with compulsory treatment are forced to be treated in a closed institution, a TBS with conditions is not forced, they often stay in an addiction clinic or a forensic psychiatric clinic.
There is no maximum period of TBS. Judges can continue to extend the TB treatment if the chance of relapse has not decreased sufficiently. This extension can be imposed annually or every two years by a judge.
