(Finance) – In compliance with the sentence of the Council of State theCompetition and Market Guarantor Authority redetermined the amount of the pecuniary sanction imposed ad HERA and ad Herambiente which thus drops from 1,898,700 euros to 316,450 euros.
The companies – explains the Agcm in the weekly bulletin – “have committed an abuse of a dominant position contrary to article 3, law 287/90, consisting in having assigned, exclusively, to the subsidiary Akron SpAwithout any fair, transparent and non-discriminatory comparison and at a price lower than the market price, the waste from HERA SpA’s joint urban collection, with a consequent higher level of the tariff/tax for the urban hygiene service in the Municipalities where HERA SpA is the Manager and with the exclusion of Akron SpA’s competitors from access to an essential input for the production of pulp 1.02″.
