Doctor UA injected the fat he took from his belly into Enes B’s facial area. After the procedure, Enes B., who came out of the anesthesia, realized that he could not see in his left eye. Enes B. appealed to the court when he talked to his doctor and could not find a solution to his vision problem.

In the petition submitted to the Istanbul Consumer Court by Enes B’s lawyer Selahattin Par, it was stated that the defendant physician, who took Enes B in late for the procedure even though he was first in line, was in a hurry, saying he had to catch up with other patients.

In the petition, it was stated that the operation, which was said to take approximately 2 hours before the procedure, was completed in 35 minutes, and it was noted that the defendant hospital and the doctor did not make any explanation to the patient about the procedure.

It was stated in the petition that a doctor from the hospital’s eye service was called for Enes B., who said that he could not see after the operation, and that this doctor referred Enes B to the eye hospital.

In the petition, it was requested that 1 million lira be paid in non-pecuniary damages to compensate for the damage caused.

A DOCUMENT WAS FORCED TO SIGN

Making a statement regarding the process, Enes B’s lawyer Selahattin Par said that his client was experiencing a psychological crisis and that his quality of life would be significantly affected.

Par stated that the doctor did not allocate the necessary time to his client during the procedure and did not explain the risks to the patient, and claimed that they tried to force Enes B to sign some documents after he lost his vision.

“We filed our case, received all the records through the lawsuit, and there we saw that our client was blind in one eye because the necessary attention and care was not taken. The file in the case was sent to the forensic medicine department, and a report was received from the forensic medicine that there was no possibility of seeing the left eye again. The patient was asked to sign the consent We also have consent forms clearly stating that the patient’s medical condition was tried to be obtained after the surgery. Unfortunately, there is negligence on the part of a doctor and the hospital. Our client lost one of his eyes at a young age. “He will go to his expert and there the financial amount of our client’s damage due to eye loss will be determined and the case will be decided accordingly.”
