It was at the podium during a council meeting in Nyköping on April 27, 2021 that Bertil Malmberg, then SD member, gave the attention-grabbing speech.
“Raises questions”
Malmberg has been convicted of incitement against a ethnic group in two instances, and now the case is also being tried in the Supreme Court. HD writes, among other things, that “the case raises questions about the scope of freedom of expression in political contexts”.
Malmberg has appealed the judgments in both instances, citing that freedom of expression should weigh more heavily during political debate.
Previously, the Attorney General has said that they also want the case to be tried at the highest instance in Sweden. My Hedström, agency manager at the prosecutor’s office, says at the same time that she considers the statement to be beyond the limits of the law.
– He could have got his message across without offending a group of people by talking about education level, for example, says My Hedström.
Am hopeful
Around 30 criminal cases receive leave to appeal in the Supreme Court each year.
Bertil Malmberg tells SVT that he sees the trial permit as a step forward.
– I hope that these lawyers come to a better conclusion than the previous ones, he says.
