Like many motorists, it is possible that you have committed a traffic infraction which has resulted in a fine and the loss of some license points. In fact, since the establishment of the points-based license system in 1992, each traffic offense has resulted in a deduction of one to six points, or even up to eight in the event of multiple simultaneous offenses. In the most serious cases, losing all of the initial twelve points may result in the suspension of your driving license, followed by the obligation to follow a road safety awareness course in order to try to recover some points. But there is a way to avoid going through this. A law firm has set up a mobile application for Android and iPhone allowing legal dispute procedures to be carried out at lower costs.

This application, called Flash Radar, allows you to contest the withdrawal of points on your driving license for speeding, crossing red lights or even failure to wear a seat belt. Please note, this only works for traffic offenses recorded without interception of the vehicle, that is to say thanks to the 4,500 radars scattered along the roads. To do this, the legal deadline for contesting must not be exceeded – it is 45 days from the date of the notice appearing at the top right of the document – ​​and you must not have paid the fine.

Available on smartphones, this service is free to download. Once installed, you must send a photo of your ticket, which will be analyzed by an AI to determine if an appeal is possible. If this phase is conclusive, the law firm of Maître Éric de Caumont, at the origin of this application, will undertake the legal steps on your behalf for the sum of 57 euros. You will be able to follow the progress of the file in real time from the customer area.

Please note that it is impossible to waive the fine, only to prevent the withdrawal of points. According to Maître Éric de Caumont, the approach has a strong chance of success because, upon receipt of the fine, nothing obliges the holder of the registration document to admit his fault – which he does by paying the fine – only whether he was driving the vehicle or not. If you choose not to do so, it is up to the public prosecutor to prove that you were behind the wheel using the photo taken by the radar, which must formally identify the driver. However, in 98% of verbalizations, this condition is not ensured.

Despite everything, only 2% of fines are appealed. This is due to three factors. First, drivers do not know their rights. Then, the procedure can be discouraging and tedious, and often ends in failure if the person concerned attempts it alone. It is absolutely necessary to see a lawyer and, for that, you have to pay between 500 and 600 euros… The goal of Flash Radar is therefore to make the law accessible to everyone – instead of making it accessible by money. A great initiative!
