In an interview on a radio show, Trump said to the presenter, “When you become president, you will have to make a choice. You will either give yourself amnesty or you will have to fire Jack Smith. Which will you do?” He answered the question.

Claiming that Smith was a “cheater”, Trump stated that he would “fire Smith in 2 seconds” and that this issue would be “one of the first issues to be addressed” when he became president.
HE REJECTED THE ACCUSES
Former President Donald Trump rejected the accusations against him in the criminal case filed by prosecutor Smith in August 2023 due to the January 6 Congress raid events and his attempt to interfere with the 2020 presidential election results.
Trump applied to the Court of Appeals to dismiss the case, arguing that he was on duty at the White House during the January 6 events and had “immunity” as President. The US Supreme Court ruled on July 1 that Trump had “immunity on some issues” for his role in the January 6 Congressional raid and allegations of interference in the 2020 elections.
The court ruled by a vote of 6 to 3 that Trump had immunity from prosecution for his official actions, but that this immunity did not apply to his private behavior.
It was also reported in the news that on October 2, Prosecutor Smith prepared a new indictment arguing that Trump’s “crimes basically fell into the private sphere” and that the former president “should be tried like all other citizens.”
Judge Tanya Chutkan, who gave Trump’s team until November 7 to respond to Smith’s indictment, must decide whether Trump will be tried after reviewing the defenses of both sides.
