The Central Netherlands District Court said earlier that the mayor should not have done that, but Dijksma appealed. The highest administrative court, the Council of State, now rules that the court was right and that the measure is not possible. “The mayor had imposed the penalty on the basis of the General Local Regulation of Utrecht (APV), but it only offers the possibility to act if someone calls for a disturbance in a physical location, not if that call is made digitally.”
