Didn’t get to sue Disney after death – now the company is turning around

The woman died last year after eating at a restaurant in Disney Springs, Florida. She was lactose and nut allergic and suffocated from an allergic reaction, despite the staff having guaranteed that the food did not contain the substances.

Her husband chose to sue Disney for the equivalent of just under SEK 500,000, but was told that his subscription to Disney+ prevents him.

He had recently signed up for a trial period on the streaming service and the terms of the agreement meant he waived his right to sue Disney, the company said.

– This is a rather shocking argument from Disney. The way this agreement is being used against the consumer is so unexpected, so far from anything a consumer would imagine when signing up for a video streaming service, legal expert John Davisson said after the news.

But now Disney is writing CNN that they have repented and will allow an ordinary judicial review.

“At Disney, we strive to put humanity above all other considerations. With circumstances as unique as those in this case, we believe this situation warrants a sensitive approach to expedite a resolution for the family who has experienced such a painful loss,” Josh D’Amaro, chairman of Disney Experiences, said in the statement. .

“We have decided to waive our right to arbitration and let the case proceed in court,” says the chairman of the board according to CNN.
