A man in his 20s is acquitted by Norrköping District Court – despite driving a moped class 1 without a driving license, writes Norrköpings-Tidningar.
The district court states that the man was not aware that he had to have a driving license and therefore did not intentionally break the law.
The man says that he contacted the Swedish Transport Agency to ask if a driver’s license was needed and then received the answer that this was not the case because he was over 18 years old. He should not have known that there were different classes of mopeds, he states.
The district court considers the man’s mental ability and that he is under trusteeship in his decision.
The fact that the man himself contacted the police to report that his moped helmet had been stolen and that he on his own initiative showed his certificate of ownership on the class 1 moped indicates that he did not understand that he had committed a crime, according to the district court.
