A seemingly powerful item was up for sale for real money in Diablo Immortal. However, players noticed that the effect was different than described – and the description was quickly nerfed. This is exactly why Blizzard is now threatened with a lawsuit.
Which item is it about? Blessing of the Worthy is one of the Legendary Gems in Diablo Immortal. It’s the only one that can be purchased directly for real money in the game’s shop.
The gem is offered in various bundles ranging from €30.99 to €119.99. Blessing of the Worthy is one of the best gems in the game for some of the classes – or was before it was basically nerfed.
What has been changed? Originally, the gem’s description promised that while wearing it, you have a chance to deal 12% of your maximum health as damage. But this effect was never true.
Instead, the gem did 12% current life damage. Especially for barbarians who can survive with one life point per ability, but actually have a large life pool, the gemstone is actually useless.
The creators therefore changed the description of the gemstone in October 2022 to correctly reflect the actual condition. The reaction at the time was overwhelmingly negative. Some even said: the players have never been so angry.

Lawyers from the Washington company Migliaccio & Rathod have now been made aware of the case by the Communications Workers of America (CWA for short), as the company itself says. The CWA also includes the union that was founded by CoD Warzone maker Raven Software.
Migliaccio & Rathod specialize in class action lawsuits and are now looking for players to complain about the Blessing of the Worthy change. For this purpose, the company has set up a form for those affected to report.
The lawyers write:
Instead of offering refunds in the form of compensation, Blizzard replied to the community that they would change the item description text to reflect the actual effect. This practice essentially amounts to loss-leadership, as the purchasable item advertised an effect that players wanted but ended up being something else entirely.
In a class action lawsuit like the one planned by Migliaccio & Rathod, one judgment is usually enough to indemnify all plaintiffs if they can show that they are affected by the same facts. There is no such form of legal action in Germany.
There is currently no public statement from Blizzard. We at MeinMMO have also requested a statement, but we have not yet received an answer.
