Defense needs time to review accused killer’s fitness report, court hears

The next steps in the case of a Tilbury man charged with second-degree murder could be known next month, a Chatham court heard.

Ken Baylis, 34, appeared in a Chatham court by video link Wednesday. He was charged in April 2023 after Daniel Marchand, 45, was found dead in a Tilbury apartment.

Defense lawyer Greg McGivern told court Baylis had undergone an assessment of his fitness to stand trial, and the defense recently received a 32-page report prepared by psychiatrist William Komer.

The lawyer said he has begun to review the report, but will need more time to “review the report with Mr. Baylis (and) explain what Dr. Komer’s findings were.”

Crown attorney Robert McDonald reached out to him about a planned discussion regarding the case, McGivern added.

The matter was adjourned to Oct. 17. Baylis remains in custody.

McGivern told court that after his discussion with the Crown, there are about three avenues the case can go.

“We will likely be in a position to start down one of those avenues,” he added.

A publication ban is in place on evidence heard during the pre-trial phase of the case.

According to previously published reports, Chatham-Kent police found Marchand’s body in a Dufferin Street apartment complex in Tilbury on April 26, 2023.

Marchand, who hadn’t been seen since April 15, was reported missing four days later, police have said.

Police have said the coroner’s office was contacted and began a death investigation. That led to a post-mortem examination, which determined the preliminary cause of death was homicide.
