Hunter Biden’s lawyers had argued that David Weiss, who led the investigations into both cases against Biden’s son and was appointed Special Prosecutor by the US Department of Justice, was unlawful in his appointment to the tax evasion case in California because he is a lawyer practicing in the state of Delaware and that Weiss has no jurisdiction in California. The application to dismiss the case within this framework, filed by the lawyers of Hunter, 54, the first son of President Biden, was rejected by Judge Mark C. Scarsi in California on Monday.

Hunter Biden was found guilty of lying to an official while purchasing a gun in 2018, making a false statement on his application form that he did not use drugs, and illegally possessing a gun he purchased for 11 days in another case heard in Delaware on June 11. Hunter Biden, who could face up to 25 years in prison, will have his sentencing hearing on November 13, eight days after the US presidential election on November 5.
US President Biden had previously said that he would not issue a pardon for his son Hunter. On the other hand, the US press suggests that Biden may change his mind before leaving the White House on January 20.
It is stated that even if Hunter Biden receives a prison sentence, this sentence may be limited to supervised release.
